Mywebtales Canvas Terms of Use

Last Updated: [DATE]

DRAFT — this page has not been reviewed by a lawyer. This supplements the main Terms of Use rather than replacing it; have counsel confirm the two documents don't conflict, and fill in all bracketed placeholders before publishing.

  1. Acceptance of these Canvas Terms

These Canvas Terms of Use ("Canvas Terms") govern your participation in the Mywebtales Canvas creator program ("Canvas"), operated by [COMPANY NAME] ("Mywebtales," "we," "us"). They apply in addition to, and supplement, our main Terms of Use. Where the two conflict on a matter specific to Canvas, these Canvas Terms control. By uploading or publishing content through Canvas, you agree to these Canvas Terms, our Community Policy, and our Privacy Policy.

  2. Changes to these Canvas Terms

We may update these Canvas Terms from time to time. We'll update the date above and, for material changes, notify you in-app or by email. Continuing to publish through Canvas after an update means you accept the revised terms.

  3. Definitions

Creator Profile means the public-facing page you customize to represent yourself as a Canvas creator.

Digital Content means the chapters, episodes, art, and related media you publish through Canvas.

User Postings means any content you or other users submit to Canvas, including Digital Content, comments, and profile content.

  4. Eligibility

You must be at least [AGE, e.g. 13] years old to participate in Canvas. If you're a minor in your jurisdiction, you may only participate with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Canvas Terms on your behalf and is responsible for your activity on Canvas.

  5. License to Your User Postings

You keep ownership of everything you publish through Canvas. By posting, you grant Mywebtales a non-exclusive, worldwide, royalty-free license to host, display, distribute, monetize, and promote your User Postings on the Service and in marketing for the Service, for as long as they remain published on Canvas. This license lets us do things like feature an excerpt of your work in an email or use a panel in an ad for Canvas. Once you remove a posting from Canvas, we stop making new uses of it under this license, though uses already made while it was live aren't undone. We will not sell your Digital Content to an unaffiliated third party.

  6. Your Warranties

By publishing through Canvas, you confirm that you own or have obtained all rights necessary to post your content and to grant the license above, and that your content doesn't violate our Community Policy or infringe anyone else's copyright, publicity, or other rights.

  7. Monetization

Ad revenue sharing. If your series is accepted into our ad revenue sharing program, we'll display ads alongside it and share a portion of the resulting net revenue with you on the schedule and terms set out in the separate Ad Revenue Sharing Program Terms. [DESCRIBE REVENUE SHARE %, PAYOUT THRESHOLD, AND PAYOUT METHOD, OR LINK TO A SEPARATE PROGRAM TERMS PAGE.]

Coins and gifts. Readers may unlock your chapters or send you gifts using Coins, as described in our main Terms of Use. Your share of Coin-based earnings, payout thresholds, and payment method requirements are set out in [LINK TO CREATOR PAYOUT TERMS]. We don't guarantee any minimum level of earnings from either program, and may withhold payment if we determine your content or account violates the Agreement.

Taxes. You're solely responsible for any taxes owed on amounts you earn through Canvas, and for providing accurate payout and tax information. We're not responsible for a misdirected payment caused by incorrect information you provided.

  8. Content Moderation

We may use automated tools and human review to monitor Digital Content and User Postings for compliance with our Community Policy and applicable law. Content that violates our policies may be removed, restricted, or subject to the appeals process described in our Community Policy.

  9. Acceptable Use

In addition to the rules in our main Terms of Use, you agree not to: impersonate another person or misrepresent your affiliation with any content; let anyone else use your account to publish; scrape or harvest data from Canvas; interfere with the normal operation of Canvas; or attempt to reverse-engineer any part of the Service.

  10. Advertisements and Third-Party Links

Canvas may display advertisements from us or third parties, and may link to third-party sites or services. We don't control or take responsibility for third-party content, and your use of any linked service is at your own risk and subject to that service's own terms.

  11. Termination

You may stop participating in Canvas at any time. We may suspend or terminate your access to Canvas, with or without notice, if you violate these Canvas Terms, our Community Policy, or applicable law.

  12. Disclaimer of Warranties

CANVAS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DON'T GUARANTEE CANVAS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

  13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYWEBTALES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR PARTICIPATION IN CANVAS. OUR AGGREGATE LIABILITY TO YOU UNDER THESE CANVAS TERMS IS LIMITED TO THE AMOUNT WE'VE PAID YOU UNDER CANVAS IN THE PAST 12 MONTHS.

  14. Indemnification

You agree to indemnify and hold Mywebtales harmless from claims, damages, and reasonable expenses arising from your Digital Content, your User Postings, or your violation of these Canvas Terms or applicable law.

  15. Governing Law and Disputes

These Canvas Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law principles. [ADD DISPUTE RESOLUTION / ARBITRATION CLAUSE HERE IF DESIRED — HAVE A LAWYER DRAFT THIS; don't copy another platform's arbitration clause wholesale, since it will reference the wrong arbitration provider, venue, and contact details for your business.]

  16. Entire Agreement and Severability

These Canvas Terms, together with our main Terms of Use, Community Policy, and Privacy Policy, are the entire agreement between you and Mywebtales regarding Canvas. If any part of these Canvas Terms is found unenforceable, the rest remains in effect.

  17. Contact
